Acceptable Use Policy

Indexed Pte Ltd is in the process of being incorporated in Singapore. Pending completion of incorporation, Indexed* is operated by Han Studios (Phnom Penh, Cambodia). References to "Indexed" in this Policy refer to the current operator and its incorporated successor interchangeably.

This Acceptable Use Policy (the "AUP") governs the Client's use of the Indexed Service and is incorporated by reference into the Terms of Service. Capitalised terms have the meanings given in the Terms.

Material breach of this AUP is a material breach of the Terms and may result in immediate suspension or termination of the Service under Section 13.4 of the Terms, with or without refund at our discretion under the Refund Policy.

1. Prohibited Businesses

The Service may not be used by, on behalf of, or for the benefit of any business engaged in:

(a) Adult entertainment, pornography, escort services, or sexually explicit content of any kind;

(b) Online or offline gambling, betting, lotteries, or any form of unlicensed gaming;

(d) Manufacture, sale, distribution, or marketing of illegal narcotics, controlled substances, or unregulated cannabinoid products;

(e) Multi-level marketing, pyramid schemes, "get-rich-quick" schemes, or other businesses whose primary revenue depends on recruitment rather than sale of a genuine product or service;

(f) Cryptocurrency exchanges, initial coin offerings, NFT mints, or token-issuing platforms (passive marketing for a regulated, licensed financial service is permitted on a case-by-case basis with prior written approval);

(g) Unregulated lending, payday loans, "buy now pay later" without proper licensing, or other unlicensed financial services;

(h) Any business operating in violation of the laws of Singapore, Cambodia, or the jurisdiction in which the business operates.

2. Prohibited Content

The Client must not submit, host, display, distribute, transmit, link to, or otherwise make available through the Service any content that:

(a) Infringes any patent, trademark, trade secret, copyright, right of publicity, right of privacy, or other proprietary right;

(b) Is defamatory, libellous, slanderous, false, misleading, deceptive, or fraudulent;

(c) Constitutes hate speech, harassment, incitement to violence, or content that disparages any individual or group on the basis of race, religion, ethnicity, nationality, gender, sexual orientation, or disability;

(d) Sexualises minors or constitutes child sexual abuse material;

(e) Discloses personal data of any individual without lawful basis;

(f) Promotes terrorism, extremism, or organised criminal activity;

(g) Contains malware, viruses, ransomware, spyware, or any other malicious code;

(h) Violates any applicable advertising standards, consumer protection law, or industry regulation (including in respect of health claims, financial product claims, or food safety claims);

(i) Is otherwise unlawful in Singapore, Cambodia, or the jurisdiction in which the business operates.

3. Prohibited Conduct

The Client must not, and must not permit any third party to:

(a) Use the Service to send unsolicited commercial communications (spam), phishing emails, scareware, or fraudulent solicitations;

(b) Conduct security scanning, penetration testing, or vulnerability research against Indexed infrastructure without prior written consent;

(d) Interfere with, disrupt, or impose unreasonable load on Indexed infrastructure or any other client's Deployed Site;

(e) Circumvent any access control, authentication, rate limit, or billing mechanism;

(f) Use the Service to develop, train, benchmark, or otherwise build a product or service competitive with Indexed (see Terms § 18 — Anti-Circumvention);

(g) Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, prompts, or operational logic of the Agents;

(h) Impersonate any person or entity, or misrepresent the Client's affiliation with any person or entity;

(i) Engage in any activity that interferes with or disrupts the Service's compliance with applicable law.

4. Edit Request Abuse

Edit requests must comply with the fair-use terms in Section 11 of the Terms:

Up to five (5) edit requests per calendar month, each consisting of textual or asset changes to existing pages.
Requests must be made through the client portal and contain reasonable specificity.

We may decline, defer, or quote as paid work any request that:

(a) Exceeds the fair-use volume;

(b) Constitutes a request for structural redesign, custom code, additional pages beyond the standard set, or work that materially exceeds the Service scope;

(d) Would, if performed, cause the Deployed Site to breach this AUP, the Terms, or applicable law.

5. Domain Use

The .com domain registered for the Client's Site (and at all times owned by Indexed under Terms § 6) must not be used to:

(a) Operate any website, redirect, or other resource other than the Deployed Site as configured by Indexed;

(b) Host, redirect to, or proxy any content prohibited by this AUP;

6. Customer Data

The Client is responsible for its collection, processing, and use of Customer Data submitted through forms or other interactive elements on the Deployed Site, including:

(a) Posting an accurate, lawful, and clear privacy notice to its end-customers;

(b) Obtaining all necessary consents for the processing of Customer Data;

(d) Not using the Service to collect Customer Data that is excessive, irrelevant, or unlawful for the Client's business purposes.

These responsibilities are addressed in further detail in our Data Processing Addendum.

7. Sanctions and Export Compliance

The Client warrants that:

(a) Neither the Client, nor any of its directors, officers, or beneficial owners, is a person subject to economic or trade sanctions of the United Nations, the European Union, the United States Office of Foreign Assets Control (OFAC), the United Kingdom, Singapore, or any other applicable jurisdiction;

(b) The Client is not located, organised, or resident in a country or region subject to comprehensive sanctions; and

(c) The Client will not use the Service in violation of any applicable sanctions, export control, or anti-money-laundering law.

We may suspend or terminate the Service immediately and without refund if we reasonably believe this Section 7 has been breached.

8. Reporting Abuse

To report a violation of this AUP, including content hosted on a Deployed Site, please email abuse@beindexed.ai. We will review reports within 3 business days and take appropriate action.

9. Enforcement

Indexed may, in addition to remedies under the Terms:

(a) Investigate suspected breaches of this AUP, including by inspecting Deployed Sites, logs, and Agent activity;

(b) Remove, disable, or modify content that we reasonably believe breaches this AUP;

(c) Suspend the Service in whole or in part, with or without notice, where we reasonably believe continued operation poses a risk to Indexed, our infrastructure providers, our other clients, or any third party;

(d) Terminate the Service for material or repeated breach under Section 13.4 of the Terms;

(e) Cooperate with law enforcement, regulators, and other lawful authorities in investigating breaches.

We are not obliged to monitor any Deployed Site or Client Content for AUP compliance and are not liable for failing to do so. The Client remains primarily responsible at all times.

10. Changes

We may update this AUP from time to time. The "Last updated" date at the top reflects the most recent change. Material changes will be notified at least 14 days in advance under Section 32 of the Terms.

11. Language

This AUP is made in English, which is the controlling language.
